Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the ConnectWyze platform at connectwyze.com and any related services (collectively, the "Service"). By signing up for an account, accessing the Service, or clicking "I agree", you accept these Terms. If you are agreeing on behalf of a company, you represent that you have authority to bind that company.

2. Definitions

  • "ConnectWyze", "we", "our" — the operator of the Service.
  • "You", "Customer" — the individual or entity using the Service.
  • "Workspace" — a tenant within ConnectWyze where templates, feeds, automations, and generated assets belong.
  • "Customer Content" — anything you upload, connect, or input into the Service (templates, feeds, brand assets, customer data, etc.).
  • "Generated Content" — images, videos, and files produced by running templates against your data.
  • "Credits" — the metered unit consumed when ConnectWyze renders an image, removes a background, or performs other billable operations.

3. Accounts

You must provide accurate and complete information when signing up and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized access. You must be at least 16 years old to use the Service.

4. Plans, billing, and credits

4.1 Plans

We offer Free, Studio, Scale, and Enterprise plans. Each plan includes a monthly allotment of Credits and feature entitlements described on our pricing page. Pricing and entitlements may change; we will give at least 30 days' notice before applying changes to your existing subscription.

4.2 Subscriptions and renewals

Paid plans are billed in advance through Stripe on a monthly or annual cycle. Subscriptions automatically renew at the same cadence until cancelled. You may cancel from the Stripe Customer Portal accessible inside your dashboard; cancellation takes effect at the end of the current billing period and you retain access until then. Annual plans are billed up front for the full year.

4.3 Refunds

Charges are non-refundable except where required by law or as expressly stated in these Terms or in a written agreement we sign with you. Unused Credits do not roll over and have no cash value.

4.4 Taxes

Listed prices exclude applicable taxes (VAT, GST, sales tax) unless explicitly stated. You are responsible for any taxes owed on your purchases.

4.5 Free tier limits

The Free tier is rate-limited and excludes paid features (e.g. background removal, the real-time generation API, scheduled automations). Free workspaces that exceed published limits may be paused.

4.6 Manual / enterprise invoicing

Enterprise customers on a custom contract receive invoices generated by ConnectWyze and pay by wire or other agreed method. Net-30 terms apply unless otherwise specified.

5. Customer Content and licence

You retain all rights, title, and interest in your Customer Content and Generated Content. You grant ConnectWyze a non-exclusive, worldwide, royalty-free licence to host, store, transmit, render, and process Customer Content solely as needed to provide the Service to you, including running templates, generating outputs, delivering files to your storage, and backing up the system.

You represent that you have all rights and lawful bases required for the data and assets you upload or connect, including any personal data of your end customers (see our Privacy Policy).

6. Acceptable use

You agree not to use the Service to:

  • violate any law or third-party rights, including intellectual property, privacy, or publicity rights;
  • generate or distribute content that is defamatory, obscene, deceptive, infringing, sexually explicit involving minors, or that promotes violence or hate;
  • send unsolicited commercial messages or otherwise misuse generated assets in a way that would constitute spam under applicable law;
  • circumvent rate limits, share or resell API keys, attempt to derive source code, or interfere with the Service's normal operation;
  • upload malicious content, conduct automated scraping of the Service, or use the Service to develop a competing product.

We may suspend or terminate accounts that violate this section or that pose a security or legal risk to ConnectWyze or other customers.

7. Third-party services

The Service integrates with third-party platforms (Stripe, Google, Slack, image and storage providers, AI background removal). Your use of those integrations is subject to the third party's own terms. ConnectWyze is not responsible for outages, data loss, or policy changes by those third parties.

8. Intellectual property

The Service, including all software, design, documentation, and trademarks, is and remains the exclusive property of ConnectWyze and its licensors. These Terms do not grant you any right to use ConnectWyze marks or copy any part of the Service outside the rights expressly granted here.

9. Confidentiality

Each party agrees to protect the other's confidential information with at least the same care it uses to protect its own and not to disclose it to third parties except as needed to perform under these Terms.

10. Termination

You may cancel your subscription or delete your workspace at any time. We may suspend or terminate your access for material breach of these Terms, non-payment, or where required by law. On termination, we will delete Customer Content within 30 days except where retention is required by law or these Terms (see the Privacy Policy).

11. Warranty disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, ConnectWyze disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Service will be uninterrupted, error- free, or that Generated Content will be free of defects.

12. Limitation of liability

To the maximum extent permitted by law, in no event will ConnectWyze be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, data, or goodwill, arising out of or related to these Terms or the Service. ConnectWyze's total aggregate liability for direct damages is limited to the fees you paid in the 12 months preceding the event giving rise to the claim.

13. Indemnity

You will defend and indemnify ConnectWyze against any third-party claim arising from (a) your Customer Content, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

14. Changes

We may update these Terms from time to time. If we make material changes, we will give at least 14 days' notice (in-app banner or email). Continued use of the Service after the effective date constitutes acceptance.

15. Governing law

These Terms are governed by the laws of Malaysia, excluding its conflict-of-law rules. Any dispute will be resolved in the courts located in Kuala Lumpur, Malaysia, except where applicable consumer-protection laws give you the right to bring proceedings in your country of residence.
